Relative Objectivity?
[ send me this paper ]
A 7 page paper discussing legal impartiality and objectivity. Based
on the results of court cases heard both now and a century ago, it is apparent that judges certainly
are not impartial. They likely are not objective in their decisions, either. While this inconsistency
introduces a degree of uncertainty in law interpretation that perhaps should not be present, it does
serve to give voice to those citizens whose voices would not otherwise be heard, or taken
seriously. In this light, justices' subjectivity provides an avenue by which socially-directed
changes in the law can come alive. Bibliography lists 4 sources.

Religious Freedom: Halloween in Public Schools
[ send me this paper ]
A 6 page paper assessing the case of a public elementary school actively promoting Halloween programs in the face of protests by fundamentalist Christian parents, who claim that Halloween is a pagan celebration and that they wish the principal of the school to either (1) allow their children to be insulated from what they claim is religious instruction contrary to their beliefs, or (2) allow equal time for presenting what they believe is the opposing view. The paper discusses the anti-establishment clause; Penn’s “Holy Experiment;” Good News Club v. Milford Central School; Church of the Lukumi Babalu Aye v. City of Hialeah; and the recent growth of the Wiccan movement to conclude that the principal of the school needs to remove all religious references if s/he wishes to retain any Halloween celebrations in the school. Reno V American Civil Liberties Union
[ send me this paper ]
6 pages in length. The ruling in Reno v American Civil Liberties Union served to set a precedent pertaining to Internet censorship, free speech and sexually-related material whereby the ever-growing impact of children's cyberspace accessibility was not deemed a justifiable reason for stripping adults of their constitutional rights. The razor thin line between where government intervention is appropriate and where it is unacceptable was brought into greater focus with this particular case, inasmuch as Internet presence has invaded virtually every aspect of contemporary life. To question the legal permissibility of adult content merely because minors are able to access this same material is to run rough-shod over the fundamental First Amendment rights of every adult. Instead, the ruling inferred, alternate means must be used to dissuade minors from participating in what many deem to be inappropriate behavior, not the least of which begins with parental guidance - not government intervention. Bibliography lists 7 sources.
